The Speaker Of Parliament Has No Right To Instruct Tollbooth To Resume Work Says Deputy Finance Minister

The deputy finance minister to Ken Ofori Atta, Hon. John Kumah has spoken about the issue of toll booth workers to resume their positions.

This came up when, famous blogger, Zionfelix asked him about the words said by the Speaker of Parliament, Rt. Hon. Alban Sumana Kingsford Bagbin. 

Zionfelix asked that, the budget read was to take effect from 1st January, 2022 but why did the issue of toll booth taxes occur right away after the budget was read. 


Also, Hon. Bagbin came out to enunciate that the toll booth employees must return to work after the minister of roads and highways, Hon. Kwasi Amoako-Attah said toll booth taxes have been aborted.

Hon. John Kumah defended the road minister and chid the Speaker of Parliament using this condition. 


Hon. Kumah went on to say that the Speaker of Parliament has no power to make the toll booth workers resume their duties. 


Further, he said what the Speaker is ultra vires to the Constitution of Ghana. 


Hon. Kumah also asserted that the road minister acted within the powers of the law which is the Ghana Road tolls act.

He then explained that section one of the road tolls act gives the road minister whether to cite road tolls in the country. 


Again, he said that article 97 clause D of Ghana's Constitution says that, “any act that gives authority to any person to do something should be read to construe that, the same person has authority to revoke or change that decision “. 


He went on to explain that since the road tolls act give the road minister the authority to do so, the road minister did the right thing. 


He also explained that if the minister wants to repute an act of the road tolls act, then he has to go to the Parliament for approval first.
